The UK deadline for compliance with the ePrivacy Directive has passed. Time to take stock in how businesses are answering the call and examine the question on everyone’s mind: what happens now. The truth is revealed at Evidon Empower Europe II.

How well is everyone doing? Businesses have surely made some good progress on informing consumers about tracking and giving them choices around how their data is used. Privacy notices can now be seen across the internet on major brand websites and billions of ad impressions. Robust solutions for garnering a consumer’s consent are out there in the market. Educational campaigns about tracking, such as Google’s “Good to Know,” can be seen globally.

But one thing is certain: if you haven’t made any progress on compliance, the time for dragging your feet has passed. Today in the UK, if you don’t comply with the law you are risking enforcement action. Fortunately, there are solid, simple solutions to help you do it.

Keynoted by UK Information Commissioner Christopher Graham, Evidon Empower Europe II will assemble senior government representatives and regulators from across the EU, trade bodies, lawyers and leading online businesses for a transparent discussion about the state of the law, where the market stands, and the impact that the deadline will have on enforcement.

It will also provide every type of business with an online presence, and those advertising on the web, with practical guidance on how to comply with the Directive, from auditing their websites for tracking activity to giving consumers sufficient privacy disclosures and a means to provide their consent to be tracked.

Approaches to consent

EU member nations are still split on which standard they’re adopting to garner a consumer’s consent to be tracked—currently, roughly twice as many countries are opting for “implied consent” over the stricter “explicit consent” model—but improved, robust solutions for both options are now out there in the market. This panel will discuss those options in detail and showcase how certain businesses are approaching compliance holistically.

Michael is the Digital Economy policy advisor at the International Chamber of Commerce (United Kingdom) and is responsible for developing ICC UK’s digital economy policy agenda. With a background in International business management Michael has been leading ICC UK’s Digital Economy working group on Cookies since May 2011, engaging with major international businesses across Europe and around the world on the ICC UK Cookie Guide. Michael is a member of the International Association of Privacy Professionals and a self-confessed technology enthusiast.

Stuart Colman
Managing Director, Europe, AudienceScience

Stuart joined AudienceScience in 2008 and as Managing Director, Europe is responsible for all its businesses in the UK and mainland Europe. Driving the development and adoption of audience targeting technology, Stuart has helped build and develop the business, making Europe the fastest growing region for AudienceScience.

As European MD, Stuart is responsible for the planning, execution and delivery of strategy across all of Europe. A key focus of Stuart’s role is to continue to deliver audience targeting solutions in the 14 EU countries currently using AudienceScience’s targeting tools, as well as drive expansion of the business into new markets.

Prior to joining AudienceScience, Stuart was Head of Digital Sales for EMEA at the Financial Times where he was instrumental in persuading the FT to embrace behavioural targeting technology and introduce audience targeting solutions as part of its advertising portfolio.

A committed believer in the future of audience targeting and the potential of digital advertising to bring real value to businesses and consumers alike, Stuart is Chairman of the IAB UK’s Behavioural Targeting Council. The Council is at the forefront of online privacy, helping to shape the future of the industry and working with the government to implement the latest EU directive.

Stuart is a regular industry speaker and panelist, presenting on a number of topics including online advertising, audience targeting and privacy legislation at events throughout Europe.

Christopher Graham
UK Information Commissioner

Christopher Graham became the UK Information Commissioner in June 2009, with responsibility for overseeing the Freedom of Information Act and Data Protection Act regimes – upholding information rights in the public interest, promoting openness by public bodies and data privacy for individuals.

Christopher was Director General of the Advertising Standards Authority (ASA) from April 2000 to June 2009. From 2003-2005, he was Chairman of t he European Advertising Standards Alliance (EASE), the federation of advertising self-regulatory bodies across the EU Single Market.

Prior to joining the ASA, Christopher was for three years Secretary of the BBC. Christopher first joined the broadcaster as a News Trainee in 1973. He was a Current Affairs Producer for BBC radio and TV before becoming Managing Editor of News Programmes for TV and Radio.

Thomas Kranig
President, Bavarian State Office for Data Protection

Thomas Kranig studied law in Munich and Würzburg and then began his career in Munich as a jurist in the public service of the state of Bavaria in 1981. From 1985 to 1992, he worked as a administrative lawyer at the District Office of Aschaffenburg. From 1992 to 1995, he served as CIO of a company dealing with media issues in Nürnberg. From 1995 to 1997, Thomas Kranig worked at the District Council of Mittelfranken in Ansbach. In 1997 he was appointed as a judge of the administrative court in Ansbach, where he worked until 2010. During this time he completed his studies at the Faculty of Law of the FernUniversität Hagen with a Master of Mediation. After this, he worked at the Ansbach administrative court not only as a judge, but also as a court mediator.

In 2011 he was appointed as President of the data protection authority of Bavaria for the non-public sector.

Philip Milton
Lead policy advisor, e-Privacy, data protection and net neutrality, Department for Culture, Media & Sport

Philip Milton is the lead policy advisor for e-Privacy, data protection and net neutrality at the Department for Culture Media and Sport. He was responsible for the successful implementation of the revised EU Electronic Communications Framework completed in May last year and has formulated UK policy on net neutrality, cookies and online privacy. Before taking up his current post Philip worked across Whitehall in a range of policy positions, including posts in the Department for Business and the Serious Fraud Office. Philip has studied at the Universities of Leicester and Illinois.

Ciaran O'Kane
CEO, ExchangeWire

Ciaran O'Kane has worked in digital media for over eight years. Having initially started out as a PHP programmer and Systems Admin for e-learning and publisher startups, he then moved into a number of online sales and strategic roles wihin ad nets and publishers. O’Kane is the CEO and Founder of ExchangeWire, the global authority on data-driven advertising.

Colin O'Malley
Chief Strategy Officer, Evidon

Colin is Evidon's Chief Strategy Officer, with responsibility for product strategy and regulatory outreach. He co-founded the company and lead its initial Design Program, a collaboration with the top seven agency holding companies, leading brands and networks. An expert in privacy matters with deep connections in the policy world, he was the Vice President of Strategic Partnerships & Programs at TRUSTe from 2003 to 2009, where he developed and launched self-regulatory programs for email (including the Bonded Sender Program, sold to Return Path) and Software (Trusted Download Program). Execution across these programs drove the transition of TRUSTe to for-profit status and an A-Round from Accel Partners. Earlier he was the Manager of Product Development at NetCreations, a double opt-in email marketing firm that went public in 1999. Colin is a published author and has a BS in Economics and Human and Organizational Development from Vanderbilt University.

Alain Pannetrat
Senior IT specialist, CNIL

Alain Pannetrat is a Senior IT Specialist of the CNIL, the French data protection authority. His main interests are cryptography, smartcards, RFID, internet voting and online targeted advertising.

He is a member of the Technology Subgroup of the Article 29 Working Party, which explores data protection issues related to new technologies.

Before joining the CNIL, Alain Pannetrat was an IT Security consultant specialized in credit and debit smartcard systems. He received a PhD in Computer Sciences after conducting research at Eurecom on novel cryptographic protocols for IP multicast security.

Ellis Parry
Global Lead, Data Privacy, BP

Ellis Parry started his career as a solicitor in private practice, before joining AstraZeneca pharmaceuticals in 2001 as a specialist IT lawyer. Ellis became AstraZeneca's Global Privacy Officer in 2005, leaving to join BP as its Global Lead for Data Privacy in December 2010. At BP Ellis is responsible for devising and implementing BP's global approach to personal information handling, including the maintenance of BP's Binding Corporate Rules and BP's response to the changes in the e-Privacy Directive. Ellis has an MBA, is a frequent public speaker, has a number of published articles to his name and was the founding Chair of DataGuidance's Pharma Expert Panel.

Eduardo Ustaran
Partner, Field Fisher Waterhouse

Eduardo Ustaran is head of Field Fisher Waterhouse's Privacy and Information Law Group and an internationally recognised expert in privacy and data protection law.

A dually qualified English Solicitor and Spanish Abogado, Eduardo specialises in the legal issues that derive from the use of information technology and the Internet. Eduardo advises on the impact of EU data protection and e-commerce law on the operational activities of all types of organisations, including FTSE 100 companies and public sector bodies. He advises a number of international clients on the adoption of global privacy strategies.

Eduardo regularly manages teams of lawyers across many jurisdictions and has assisted data protection regulators from different countries to align their positions and interpretation of the law. Named by Revolution magazine as one of the 40 most influential people in the growth of the digital sector in the UK, Eduardo is also ranked as a Leading Individual for data protection by Chambers UK and in a Computerworld survey.

Eduardo advises clients in the energy, life sciences, media & entertainment, public sector, retail and technology & communications sectors.

Eduardo has been appointed to the Board of Directors of the International Association of Privacy Professionals. He is also Co-chairman of KnowledgeNet London, the editor of Data Protection Law & Policy and a member of the Panel of Experts of DataGuidance. Eduardo is co-author of E-Privacy and Online Data Protection (Tottel Publishing, 2007) and of the Law Society’s Data Protection Handbook (2004). Eduardo is a regular contributor to our Privacy & Information Law blog and has taken part in many international speaking engagements.

Eduardo regularly lectures at the University of Cambridge as part of its Masters of Bioscience Enterprise on data protection law.

Hester de Vries
Partner, Kennedy Van der Laa

Hester de Vries is one of the Dutch leading experts in data protection law.

Prior to joining Kennedy Van der Laan in 2000 she worked as a researcher at the Institute for Information Technology and Law of the Vrije Universiteit in Amsterdam where she earned her Ph.D. with a doctoral thesis on the legal aspects of teleworking and electronic consumer services.

After completing her doctorate, she worked at the Hugo Sinzheimer Institute for labor and law of the University of Amsterdam where she was an expert member of the committee of the Dutch government Social Economic Council that advised on personnel tracking systems. She then became a senior policy officer at the Dutch Data Protection Board, where she managed a major project regarding data processing and data protection.

Hester focuses her practice on the many aspects of data protection law and technology.

Erich Wasserman
General Manager, EMEA, Mediamath

Erich, a joint UK and US citizen, co-founded MediaMath in 2007 and led its sales and account teams as they built the first agency trading desks and incubated the DSP (demand-side platform) market.

In January 2011, Erich launched the company's EMEA operations with an initial office in London, and within a year established direct presences in six European markets.

Prior to co-founding MediaMath, Erich was the executive director of media solutions at [x+1], part of the founding team that launched the fastest-growing business unit within the firm. Erich's early career included the position of executive director for a civil rights organization in the US, before co-founding an organization devoted to the treatment and cure of blinding eye diseases.

Erich earned a bachelor's degree with concentrations in political philosophy and classical piano from the University of Virginia.
